Please read these Terms of Service carefully before using the Zavor & Co. website and subscription service. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our services. Questions? Contact us at [email protected].

1. Acceptance of Terms

By accessing or using the Zavor & Co. website located at https://www.zavorco.com (the "Site"), placing a subscription order, or creating an account on our Client Portal at https://member.zavorco.com, you agree to be legally bound by these Terms of Service, our Privacy Policy, and any other policies referenced herein. These Terms constitute a binding legal agreement between you ("Customer," "you," or "your") and Zavor & Co. ("we," "us," or "our"), a business located in Trexlertown, Pennsylvania.

We reserve the right to update or modify these Terms at any time. Continued use of the Site or services after any modification constitutes acceptance of the revised Terms.

2. About Our Service

Zavor & Co. is a premium food subscription service offering artisan, handmade, gluten-free Colombian arepas and premium Colombian coffee delivered directly to subscribers within our service area in the Lehigh Valley, Pennsylvania region. We offer the following monthly subscription plans:

3. Service Area and Eligibility

3.1 Geographic Restrictions

Our delivery service is currently available only within select zip codes in the Lehigh Valley, Pennsylvania region. By placing an order, you represent that your delivery address falls within our active service area. Orders placed outside our delivery zone will not be fulfilled, and you will receive a full refund.

3.2 Age Requirement

You must be at least 18 years of age to purchase a subscription or create an account. By using our services, you represent and warrant that you meet this requirement.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information when creating an account or placing an order, and to update such information as necessary to keep it accurate.

4. Subscription Plans and Pricing

4.1 Monthly Subscriptions

All plans are billed on a monthly recurring basis beginning on the date of your initial order. Prices are listed in U.S. dollars and are subject to applicable taxes.

4.2 Price Changes

We reserve the right to change subscription prices with at least 30 days' advance written notice to the email address on file. Your continued subscription after the effective date constitutes acceptance of the new pricing.

4.3 Free Delivery

Local delivery within our service area is included at no additional charge with all active subscription plans.

5. Payment and Billing

5.1 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By subscribing, you authorize Zavor & Co. to charge your designated payment method on a monthly recurring basis until your subscription is canceled.

5.2 Accepted Payment Methods

We accept major credit and debit cards as processed through Stripe. By providing payment information, you represent that you are authorized to use the payment method provided.

5.3 Failed Payments

If a payment fails, we will attempt to process the charge again over the following days. If payment is not successfully collected after multiple attempts, your subscription may be paused or canceled. We will notify you by email if a payment fails.

5.4 Billing Date

Your subscription renews automatically on the same calendar day each month as your original sign-up date. If that date does not exist in a given month, billing will occur on the last day of that month.

6. Subscription Management

6.1 Client Portal

You may manage your subscription at any time through your personal Client Portal at https://member.zavorco.com. Access is provided via a secure magic link sent to your registered email address.

6.2 Pause

You may pause your subscription at any time through the Client Portal. Pausing suspends billing and deliveries for the selected period. Billing and deliveries resume automatically when the pause period ends unless you extend or cancel.

6.3 Changes and Upgrades

You may change your subscription plan (upgrade or downgrade) at any time through the Client Portal. Changes take effect on your next billing cycle.

6.4 Cancellation

You may cancel your subscription at any time through the Client Portal or by contacting us at [email protected]. Cancellation requests received before your next billing date will prevent future charges. Cancellations do not entitle you to a refund for the current billing period unless otherwise required by law.

7. Cancellation and Refund Policy

7.1 Cancellation

You may cancel at any time with no cancellation fee. Your subscription will remain active through the end of the current paid billing period.

7.2 Refunds

Due to the perishable nature of our food products, all sales are final once an order has been prepared and dispatched for delivery. We do not offer refunds for orders that have been delivered.

7.3 Exceptions

We will issue a full refund or replacement in the following circumstances:

  • The delivered product is spoiled, damaged, or significantly different from what was ordered
  • Your delivery address is outside our service area and the order cannot be fulfilled
  • We are unable to deliver due to circumstances within our control

To request a refund or replacement, contact us at [email protected] within 48 hours of your scheduled delivery date, with a description and, if possible, photo documentation of the issue.

8. Delivery Terms

8.1 Delivery Schedule

Deliveries are made on a monthly basis in accordance with your subscription plan. Specific delivery dates will be communicated to you in advance via email or text message.

8.2 Delivery Conditions

You are responsible for ensuring that someone is available to receive the delivery or that a safe, temperature-appropriate location is available for drop-off. Zavor & Co. is not responsible for product quality if deliveries are left unattended for an unreasonable period of time.

8.3 Missed Deliveries

If we are unable to complete a delivery due to incorrect address information, inaccessible location, or other circumstances within your control, we will make reasonable efforts to reschedule. Additional delivery attempts may incur a re-delivery fee.

8.4 Service Area Changes

Our delivery service area may expand or change. If we are no longer able to deliver to your area, we will notify you at least 30 days in advance and provide a refund for any prepaid period.

9. Product Information and Food Safety

9.1 Handmade Products

Our arepas are handmade in small batches using traditional Colombian methods. Slight variations in size, shape, and appearance are normal and do not constitute a defect.

9.2 Gluten-Free

Our arepas are made without gluten-containing ingredients. However, they are prepared in a kitchen environment that may also handle other ingredients. We cannot guarantee complete freedom from cross-contamination. Individuals with severe gluten sensitivities or celiac disease should exercise caution.

9.3 Storage Instructions

Our frozen arepas must be stored in a freezer upon receipt. Zavor & Co. is not responsible for spoilage resulting from improper storage after delivery.

9.4 Allergens

Our products contain corn (masa) as a primary ingredient. Coffee products contain caffeine. If you have specific dietary concerns or food allergies, please review all ingredient information before ordering and contact us at [email protected] with any questions.

10. Client Portal and Account Access

Your Client Portal provides access to subscription management, billing history, and order information. You are responsible for maintaining the confidentiality of your account access and for all activity that occurs under your account. Your portal access link is personal and should not be shared. Notify us immediately at [email protected] if you believe your account has been compromised.

11. SMS and Text Message Communications

By providing your mobile phone number and subscribing to our service, you consent to receive automated text messages from Zavor & Co. regarding your subscription, including order confirmations, delivery notifications, billing updates, and service communications. Message frequency varies. Standard message and data rates may apply.

To opt out of SMS communications, reply STOP to any text message or contact us at [email protected]. For help, reply HELP. Opting out of SMS does not cancel your subscription.

Carrier Liability Disclaimer: Carriers are not liable for delayed or undelivered messages.

12. Email Communications

By creating an account or subscribing, you consent to receive transactional emails related to your subscription. We may also send periodic promotional emails. You may opt out of marketing emails at any time by clicking the unsubscribe link in any email or contacting us at [email protected].

13. Intellectual Property

All content on the Site — including text, graphics, logos, images, product descriptions, and the overall design — is the property of Zavor & Co. or its content providers and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our express written permission.

14. Prohibited Conduct

By using our Site and services, you agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to our systems, accounts, or networks
  • Use automated tools to scrape, crawl, or harvest content from the Site
  • Interfere with or disrupt the integrity or performance of the Site or services
  • Submit false, inaccurate, or misleading information
  • Impersonate any person or entity
  • Resell or redistribute our products without written authorization

15. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZAVOR & CO., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to Zavor & Co. in the three (3) months preceding the claim. Some states do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless Zavor & Co. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site and services, your violation of these Terms, or your violation of any rights of another party.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Lehigh County, Pennsylvania for the resolution of any disputes arising from these Terms.

19. Dispute Resolution

We encourage you to contact us first at [email protected] with any concerns. We will make reasonable efforts to resolve disputes informally within 30 days. If a dispute cannot be resolved informally, either party may pursue resolution through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, conducted in Lehigh County, Pennsylvania.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Zavor & Co.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zavor & Co. with respect to your use of our services and supersede all prior agreements and understandings.

22. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website and/or sending an email at least 14 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
